Introductory explanations

The present terms of use only apply to the sub-domain web.humanityy.com, of the site www.humanityy.com.  Please note that the site blog.humanityy.com is the blog of the organisation Humanityy, and the sub-domain web.humanityy.com includes the search engine proposed by the organisation.  This search engine is independent of the rest of the site and is subject to the legal notices and terms of use provided later.  It is under no circumstances subject to the legal notices and terms of use of the blog or of any sub-domain subsequently created, which will always have their own legal notices and terms of use.

1.      Introduction of the search engine and its objectives

The Humanityy search engine is a “charitable” search engine.  It allows the user to choose an organisation that they wish to support.  This user may then search in the index of the Google database thanks to the Humanityy engine.  The results pages that are produced contain adverts that the user may click on if it interests them.  Thanks to the Google AdSense system, this click generates a small amount of money that is transferred directly to Humanityy.  Humanityy then transfers the funds collected in this way, almost entirely (once the operational cost is deducted) to the organisation designated by the user.  This system allows the user to carry out searches on a search engine whilst generating revenue for the organisation of their choice.

2. Choice of organisation and eligibility of suggested organisations.

The organisations that users can support are suggested in a list.  The suggested organisations have been chosen by Humanityy.  Other organisations may be suggested by users but ultimately only Humanityy can decide whether to accept or reject the organisation.

Eligible organisations are nonprofit organisations under the 1901 French law, which lead concrete and practical action in the field of humanitarian work, ecology and / or animal protection.  In contrast, organisations that only focus on providing information or raising awareness are not eligible.

Users who suggest an organisation that is not on the list will receive an email informing them of the decision to integrate the organisation, or the motives for rejection if not.  This is an obligation to inform only, and the motives for rejection cannot be contested.

Humanityy is listed in the organisations that are suggested for search engine users.  Effectively, Humanityy transfers all the revenue generated by the search engine to the organisations chosen by the users, and can claim revenue generated by search engine users who support it in the same way as the other organisations.

3. Rules concerning the generation and redistribution of revenue.

The Humanityy search engine is available to the public thanks to Google Custom Search and Google AdSense.  Google Custom Search allows the Google search bar to be integrated into another internet site and suggests advertisements on the results pages via the Google AdSense programme.  Google AdSense allows advertising space to be made available on an internet site.  When an internet user clicks on one of the advertisements shown in the advertising space the person who made the advertising space available generates a small sum of money.

In this way when someone uses the Humanityy search engine, the adverts appear in the advertising space on the results pages.  The sums generated in this way are transferred to the organistion Humanityy.  However the sums are not all equal as they differ depending on the advert that was clicked by the user.  Therefore it is not possible to redistribute the exact sum of money generated by the clicks.  With a view towards equality, the amounts are not redistributed in relation to their intrinsic value of the click, and each research generates a fixed amount which is 0.0015 euros exactly.  If the average revenue generated per search reaches above 0.0015 euros, Humanityy reserves the right to conserve the extra revenue to compensate for potential losses due to a potential decrease in the average revenue generated per click.  Indeed, the revenue generated by clicks varies slightly and the system of compensation previously described can only be used to ensure equality in the transfers to organisations with an average revenue of 0.0015 euros per click.

Conversely, Humanityy wishes to respect the conditions of use of the services Google AdSense, which for example forbids users to click on adverts in order to generate revenue.  The charitable nature of the search engine encourages users to do their searches on this engine rather than any other.  However, under no circumstances does Humanityy encourage the internet users to click on the adverts suggested in the results pages.  Humanityy only describes the process of fundraising for the organisations.

As a search engine user we ask that you only click on the adverts that interest you and not click with the sole aim of supporting Humanityy and / or your organisation.

 

 

For each organization, funds can only be transfered once in every 12 months rolling time. To receive the first money transfer, the organization must have been registered in our database for at least 12 months (where date of form submission is taken into account)

To receive the money transfer, each organization must produce its bank account details, with the name and adress  of the organization. 

 

4. Donations to the organisation Humanityy may be made on this site

The search engine site Humanityy suggests a “make a donation” button which is independent of the support system linked to the engine.  In effect Humanityy transfers all the revenues generated via the Humanityy search engine to the organisations supported by users.  In order to obtain the funds required to develop our actions, particularly the creation of a social network linked to environmental and humanitarian action or even the management of the blog, it is possible to make a donation directly from the site.

5. Potential disputes and competent jurisdiction

Potential disputes linked to the use of the Humanityy search engine, at the address is web.humanityy.com, are subject to French law and will be presented before French jurisdiction.  The court of competent jurisdiction for all disputes of the above site is the Tribunal de Grande Instance de Toulouse.

However, Humanityy asks that all search engine users to contact us before any summons so that an amicable solution may be found between the parties concerned.

1. Presentation of the blog and its aims

 

The Humanityy blog aims to invite internet users to take an interest in sustainable development and humanitarian activity around the world, and to exchange ideas about subjects of their choice.  Participants can thus write a “thread” about a subject in order to begin a discussion that follows the article.  This discussion is intended to stimulate collective interest about sustainable development questions, and raise the awareness of internet users from different countries to consider global solutions.

 

2. Prohibited content and the code of conduct

 

By validating their registration, the user accepts to respect the rules of the code of conduct from then on, and is forbidden to publish “threads” containing:

  • any content violating the rights of others (private life, copyright...) or slanderous, insulting, obscene or offensive material or pertaining to the protection of children and adolescents,
  • any violent or pornographic content or anything that encourages crime, offence, discrimination or racial hate, suicide or revisionist behaviour.
  • any content permitting the precise identification of the website users, such as the postal or email address, or telephone number.
  • any content imitating the headings or manipulating the user’s identity in a manner so as to conceal the origin or the source of the initial content posted on the blog, misleading other users by usurping an identity,
  • any content publicising commercial messages, adverts or promotions or propaganda,
  • any content containing advice or comments violating other legal provisions or regulations,
  • any content that does not respect copyright laws (particularly reproduction, representation or publication of a work), current associated rights, brand law or the databaserights.

Furthermore the following behaviour is forbidden, in order to preserve the quality of the blog and to make a space that does not resemble any other, where everyone can share ideas on important global subjects :

  • interfering in a brutal or impolite manner, whatever the emotional implications linked to the subject may be,
  • write in shorthand or SMS type language or in broken English or in a familiar register,
  • Publish your articles on other platforms, forums or blogs (it’s not a formal ban but a recommendation in order to preserve the unique character and interesting content presented on the blog),
  • re-publish the same post or the same response in order to improve its listing in the most recently published posts (the blog’s search engine allows you to find the older posts on the search subject), 

Any user that does not respect the rules will have their litigious content removed and their account deleted without notice and Humanityy will not have to provide grounds for expulsion. Furthermore the user will be held legally accountable for the content published and their information may be given to the judicial authorities.

 

3. Humanityy’s responsabilities

 

Humanityy moderates all the content published by users on the blog site. The organisation reserves the right to withdraw any content suspected of contravening the French legal provisions.  Humanityy will use all the means at its disposal and current state of knowledge in this area to remove such content.Humanityy is therefore subject to an obligation to eliminate illicit content. A button « Report illicit content » is present on all the blog pages so that users can alert the moderator of the content.  In such cases Humanityy endeavours to do everything possible to remove the reported content as soon as possible. This obligation only concerns content of the sub-domain blog.humanityy.com and in no case can Humanityy be held responsible for the content on the sites presented in the pages accessible via hyperlinks. 

Furthermore, internet users wishing to use the services of the blog made available by Humanityy accept to abide by the codes of conduct of the blog, announced in article 2 above, from the moment they validate their registration on the blog site. Any user who does not respect the rules included in the code may have their account deleted without notice and the content partially or totally withdrawn. They will also be held responsible and their information permitting identification will be transferred to the competent judicial authorities as requested.

 

4. Protection of blog content

 

The content of the blog itself (code source, templates, graphic design, etc.) belongs to Humanityy and cannot be used without written authorisation from them.

The content of the « threads » published on the blog is protected by copyright laws. Authors of the threads reserve the moral rights attached to their material but concede a non-exclusive licence that is worldwide, transferable, sub-licensable without a licence fee to Humanityy who can then reuse certain content particularly in RSS files.

 

5. Potential disputes and litigation

 

The potential disputes linked to the use of the Humanityy blog, at the address blog.humanityy.com are subject to French law and will be presented in French court. The court of competent jurisdiction for any disputes linked to this site is The Tribunal de Grande Instance de Toulouse.
